Who are we?
We are UPP BV , a private limited liability company, incorporated in Amsterdam and with our head office at Overtoom 143, 1054 HG in Amsterdam. Our Chamber of Commerce number is 88722031. Our website is https://upp.store . In these terms and conditions we refer to ourselves as UPP .
The Agreement
An agreement is concluded when you, the consumer, place an order on our website.
UPP reserves the right to refuse an order or request additional information before accepting the order.
These general terms and conditions
Before placing an order, you have downloaded, read and accepted these general terms and conditions by clicking on the 'check' button.
We may change these terms and conditions at any time. We will notify you of this by email.
Offers and quotes
All offers and proposals from UPP are without obligation and valid for the period stated therein.
Prices and payment
The prices of our products are stated on our website and are expressed in euros, including VAT and excluding shipping costs, unless otherwise stated.
Payment is made in advance via iDEAL or credit card .
If there is a problem with payment before the product is delivered, we will delay delivery until payment has been successfully processed.
In case of payment problems after delivery of the product, we will send a payment link by email with a payment term of 14 days.
If no payment is made within 14 days, we will be forced to engage a debt collection agency. The associated costs will be at your expense.
We reserve the right to change prices at any time, but these changes will only apply to new orders.
Right of withdrawal
As a consumer, you have the right to cancel your purchase remotely within the 14-day cooling-off period, provided you have not yet opened our product.
In case of a correct cancellation, we will refund the standard shipping costs for the return and the refund will be processed via the same payment method you used for the original purchase. If you have chosen a more expensive delivery than the standard delivery, you will be responsible for the additional costs.
If you have not exercised your right of withdrawal, the purchase of the product will be considered final.
Compliance and liability
We stand behind our product and ensure that it not only meets all legal requirements, but also the highest quality standards.
If you experience any problems with our product, we kindly request that you report this within 7 days of receipt, so that we can immediately send you a replacement product. If you do not report any problems within this period, we will assume that you have received the product in good condition.
In the event of direct damage resulting from a defect in our product, our liability is limited to the amount covered by our insurance company, plus our own risk. If the insurer does not provide cover, we accept liability up to three times the price of the product.
We are not liable for any indirect damage resulting from the use of our product.
Our product has a shelf life until the date indicated on the packaging. After this date we no longer guarantee the quality of the product, nor do we accept any liability if you choose to use the product after the expiration date.
After opening, our product remains suitable for consumption for 365 days if stored dry and at room temperature. However, even after this period, we do not give any guarantees or accept any liability for the quality of the product.
Please note that our product is intended for your own use only. You agree to indemnify us from any third party claims directly or indirectly related to our product and you will compensate us for any damages resulting from such third party claims.
Intellectual property
The intellectual property of our product, including the packaging, our name and our logo, remains with us.
Feedback and complaints
We value your feedback and take it very seriously. If you have feedback or would like to report a complaint, please do so by email to info@upp.store .
We aim to handle complaints within 14 days of receipt.
Personal data
We treat your personal data with the utmost care and comply at all times with the General Data Protection Regulation ( GDPR ). For more information about our policy, please refer to our Privacy Statement on our website.
Other matters
If any provision of these terms and conditions is declared void, invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Dutch law applies to all our agreements and general terms and conditions.
